Specialized return-to-duty solutions for bus operators, train operators, and other safety-sensitive transit employees
Our specialized services are designed specifically for transit employees regulated by the Federal Transit Administration who have violated DOT drug and alcohol testing regulations.
The Federal Transit Administration has specific requirements for safety-sensitive employees who have violated drug and alcohol regulations. Our DOT SAP professionals understand these nuances and provide:
The FTA requires transit agencies to test safety-sensitive employees for drugs and alcohol under specific circumstances, including pre-employment, random testing, post-accident, reasonable suspicion, return-to-duty, and follow-up testing. Violating these regulations requires completion of the SAP process before returning to safety-sensitive duties.
Our structured approach helps transit professionals navigate the return-to-duty process efficiently while ensuring full compliance with FTA regulations.
Your journey begins with a comprehensive evaluation by our DOT-qualified Substance Abuse Professional. This face-to-face assessment examines your substance use history, previous violations, and current situation to determine appropriate recommendations.
FTA-Specific: We understand the unique stress factors and work conditions in mass transit operations and how they may contribute to substance use issues.
Based on your initial evaluation, we recommend an appropriate level of education and/or treatment. This may range from educational programs to intensive outpatient treatment, with all recommendations selected to accommodate transit work schedules when possible.
FTA-Specific: We maintain relationships with treatment providers who understand transit industry schedules and can offer flexible timing for sessions.
You'll complete all recommended education and/or treatment programs. Throughout this process, we maintain communication with your treatment providers to monitor progress while respecting confidentiality.
FTA-Specific: We understand the importance of getting transit professionals back to work efficiently while ensuring public safety remains the top priority.
After completing your recommended program(s), you'll return for a follow-up evaluation. We'll assess your progress and determine if you're ready to return to safety-sensitive functions.
FTA-Specific: We evaluate readiness based on both general DOT requirements and specific considerations for transit safety.
Upon successful completion of the follow-up evaluation, your employer will be notified that you're eligible for a return-to-duty test. This test must be directly observed and have a negative result.
FTA-Specific: We coordinate with transit employers to ensure testing is conducted according to FTA regulations.
We develop a follow-up testing plan consisting of at least 6 tests in the first 12 months, with the possibility of extending up to 5 years. This plan follows you even if you change employers within the transit industry.
FTA-Specific: We create testing plans that account for irregular transit work schedules and varying shift patterns.
Common questions about the FTA DOT SAP process for transit professionals
The timeline varies based on individual circumstances and recommendations. For transit employees, the process can take anywhere from 2-8 weeks depending on the required level of education/treatment and your compliance with recommendations. We work to expedite the process while ensuring compliance and readiness to return safely.
The core SAP process is consistent across all DOT agencies, but the FTA has specific regulations under 49 CFR Part 655 that apply to transit operations. These may affect certain aspects of testing procedures and return-to-duty requirements. Our SAP professionals are familiar with these nuances and ensure complete compliance with FTA-specific regulations.
While you cannot perform safety-sensitive functions during the SAP process, whether you remain employed is up to your transit agency's policy. Many agencies have non-safety-sensitive positions available during rehabilitation. We can provide documentation of your participation in the SAP process, which some employers consider when making employment decisions.
Costs vary depending on several factors, including the type of evaluation, recommended treatment, and your location. The initial evaluation typically ranges from $400-$600, and the follow-up evaluation is similar. Treatment costs vary widely based on recommendations. We offer payment plans to help manage these costs, and some transit union benefits may provide assistance.
Your employer will receive documentation regarding your eligibility for return-to-duty testing and the follow-up testing plan. They will not receive detailed information about your diagnosis, treatment recommendations, or personal information shared during evaluations. We maintain strict confidentiality while providing employers with the information required by FTA regulations.
